Thinking of trading up on an investment resort property? If so, look into 1031 Tax Exchanges (based on IRS Code Section 1031), which allow taxpayers to defer taxes on capital gains resulting from the sale of investment real estate, often a sizable sum since combined Federal and State taxes can run as high as 38 percent.

With an exchange, owners are able to preserve equity, while still selling the property. The underlying concept is that an exchange of like-kind property for like-kind property does not generate funds, which can be taxed since the profits go directly into the new or replacement property. To accomplish this, sellers hire a Qualified 1031 Intermediary (QI) to document the sale as an exchange and to receive the funds from the sale. The QI then delivers the funds directly to the closing agent for the replacement property who deeds the property to the taxpayer.

Central to a 1031 Exchange is the interpretation of like-kind property. While the common assumption is that like-kind implies land for land or a condominium for a condominium swap, the interpretation of like kind is actually less literal. Rather, it defines like kind as meaning that both the replacement and the original property must be used as an investment. So land, condominiums, single-family homes and motels can all be exchanged for one another as long as they are used in the exchanger’s business or held as an investment. The amount of debt held on the replacement property must be the same as the amount of debt on the original.

1031 Exchanges are complex mechanisms and like all IRS requirements very specific. For example, exchangers have 45 days from closing to identify properties they intend to purchase and 180 days to complete the purchase. Purchase and Sale agreements must include verbiage indicating the intent to affect a 1031 Exchange.

The 45-day time frame used to be onerous for sellers. Now, they can opt for a Reverse Exchange, in which an additional third party called “the exchange accommodation title holder” (EAT) acquires title to the replacement property until the original property sells. Reverse Exchanges shift the 45- and 180-day time frame to the selling side of the transaction. With an Improvement Exchange, which also uses an EAT to hold the replacement property, sellers can build investment properties from the ground up or improve existing properties. The improvements have to be built and paid for during the 180-day period.

If you are interested in a 1031 Exchange, the first step is to consult your tax advisors as well as an attorney or CPA who is knowledgeable with 1031 Exchanges. Make sure that your real estate professional knows you plan to conduct an exchange and be sure that he or she is familiar not only with the process but also with the specific documentation and time frame mandated by the IRS.

The first in our four-part series of Hawaii vacations takes us to the island of Oahu, “the Gathering Place”. In subsequent articles, we’ll explore the islands of Maui, Kauai, and the Big Island.

Oahu is Hawaii’s third-largest island and its most developed. Honolulu is the “hub” of all the islands combined, providing many activities and accommodations, along with a feeling of escape and pure relaxation in year-round balmy weather.

Nearly three-quarters of Hawaii’s approximate 1.2 million reside on Oahu and about 400,000 live in Honolulu.

Oahu is a good place to start your Hawaiian vacation. More flights arrive in Honolulu from the U.S. mainland and elsewhere than at any other airport on the Hawaiian Islands.

It is also the cheapest Hawaiian island to visit. The only one of the islands that has inexpensive island-wide bus service, it is possible to experience the island without having to rent a car.

Oahu boasts mountains rising from the coast to 2,000 feet with fragrant flowers, sparkling waterfalls, and a jungle-like tropical forest. Daily average temperatures are in the low 70s during the coolest months, February and March, and around 85 degrees in the hottest months, August and September.

Most hotels on Oahu are found around Waikiki, a good base for your adventures on the island. In addition to the usual shopping malls, bookstores, restaurants, bars, art museums, entertainment and cultural activities of a typical American city, Honolulu has unique Hawaiian offerings.

Hanauma Bay, east of Waikiki, is the best snorkeling area in all of the islands, while Kailua Bay is the island’s top windsurfing spot. There are many types of activity. From surfing or snorkeling lessons to helicopter tours and dinner cruises, you can find it here.

You can discover the underwater world on a submarine tour. “Atlantis Submarines” will take you directly to the island’s plentiful sea life, from exotic fishes to coral and turtles, all circling around you as you descend to the floor of the ocean.

Pearl Harbor and the USS Arizona Memorial remain one of the most visited sights on the islands. Be sure to include it in your Oahu itinerary. The visitor center for the memorial is located six miles west of Honolulu.

For the hardier, more adventurous traveler, the hiking possibilities are wide open. You can either set out on your own (some very intricate but well-traveled hiking trails are reachable by bus) or book a tour with one of the island’s hiking companies.

You can literally go from viewing ancient Hawaiian temples to 21st-Century high-rises, then move from the “Town” to the “Country,” just 45 minutes away.

No Oahu trip would be complete without a visit to the North Shore, the world’s surfing capital. This part of Oahu remains rural and undeveloped in places. The hotel and golf course at Turtle Bay comprise the only resort in the area.

Haleiwa, the main town of the North Shore, is 24 miles north of Honolulu. It has been a mecca for surfers from all over the world since the 1960s, however it is not an area for inexperienced surfers. This is an easy day trip from Waikiki.

Whatever adventures you encounter on Oahu, whether it is learning to surf at Wakiki, climbing the stack at Diamaond Head, or enjoying the warm sand of a beach, your vacation will end too soon for you to discover all this island has to offer. Perhaps next time….

5) TRAINING. In network marketing, the people on your team will most likely help one another to succeed, therefore make sure that you belong to a successful team and that there are regular training sessions scheduled and that your sponsors are easily available for questions and support.

Once you have made the decision to start up in network marketing system, make a commitment to spend between 10 to 15 hours a week to start this business. Many people have been able to match or surplus their salaries by network marketing, however this requires motivation and commitment, but the rewards can be staggering levels of financial success and freedom

Online investing is becoming more and more popular with each
passing day, but is this really the way to make your fortune and
should you rush to join this online investing crowd?

Investing in individual company stocks and in shared
investments, such as mutual funds, is a common practice around
the world and, in recent years, a huge number of small private
investors have joined the investment bandwagon. It is not
surprising therefore that many of these private investors are
now moving away from the traditional brokerage houses and are
turning to the internet to manage and grow their portfolios. But
is this rush towards the internet a wise move?

Let’s examine some commonly expressed thoughts by those turning
to online investing.

First, there are those who say that they are going to make a
killing online.

As with most things in life, online investing can make you a
fortune, but it can also result in you losing your shirt.
Indeed, studies have shown that the most active online
investors, the day traders, tend to lose more than they win.
Nevertheless, if you do your research, make careful are reasoned
decisions about your investments and maintain a balanced
portfolio, then online investing can produce very acceptable
results.

Second, there are those who believe that investing online is
particularly advantageous when it comes to making a killing on
highly profitable initial public offerings.

When publicly traded companies make a new offering of shares to
investors, the price often rises sharply in early trading,
making them very popular with investors. However, there is
almost always a very high demand for these new share offerings
and the number of investors who benefit from these issues is
very small.

Third, many people believe that by investing online they can
benefit from the fact that their shares are purchased the moment
that they place their order.

The moment at which your purchase is actually made however
depends upon a number of factors but, in times of heavy trading,
your purchase can take anything from a matter of minutes to
several hours to complete. This means of course that the price
shown when you click the buy button may well not be the same as
the actual purchase price you end up paying. There are of course
systems in place (such as limited orders and stop-loss orders)
to counter this effect, but you need to understand the detail of
the buying process online if you want to avoid getting your
fingers burnt.

Fourth, there are those who believe that the real beauty of this
form of investment is that it allows them to trade at any hour
of the day or night.

While online investing allows you to access your account at any
time, and place orders whenever you wish, any orders placed will
only be executed during normal market trading hours and, even
then, they may be subject to delay in heavy trading periods.

These, and many other, common misconceptions abound in the
investment world and the reality is that the internet represents
nothing more than the latest bandwagon. It is not, however, the
answer to the investor’s prayer and it is simply another tool
that can be added to your investment toolbox.

For many, particularly seasoned and experienced investors,
online investing does indeed represent a very good way to
increase your investment income. To others, and especially to
the inexperienced or novice investor, online investing needs to
be researched carefully before you decide whether or not it is
right for you.

Take your time and do your homework before jumping on this
particular bandwagon or your super highway to fortune will
rapidly turn into a dirt track to ruin.

The permissive and participatory conduct which most
employees take for granted, eventually escalates into the
more serious assaultive behavior commonly referred to as
employee on employee workplace violence starts with
innuendos, a bad word, or simple jokes taken out of context
or used to inflame another. Initiation of a proper and
thorough investigation is possible under the auspices of a
Threat Assessment Team. Banter between employees if left
alone by supervisors becomes tense and often results in a
more aggressive response. The truth of the matter is that in
most cases this banter is perceived as harmless shop talk.

Supervisors often believe that this healthy shop talk builds
camaraderie and does not detract from performance. However,
such permissive behavior empowers the potential perpetrator
who may feel he enjoys the partiality of the supervisor.
After all, he does his job, pumps out the numbers and meets
the “bosses” demands. Regardless of the relationship and his
performance, definite and clear action should be taken
initially to curtail the potential of an explosive situation
from impacting the workplace. The spontaneous reaction by
the victim although surprising could be sufficiently volatile
to affect bystanders as well.

Remembering that the business owner is ultimately
responsible for the actions they fail to take in any
situation places the decision in question. The prevention of
workplace violence requires a proactive response. Security
is everyone’s responsibility but ultimately management’s duty. The exposure to violent behavior by non employees is yet another issue which will be presented in future articles.

In a permissive environment, the uninformed employee has no
idea that emotions tied into simple acts of harassment are
an explosive combination often leading to a spontaneous
counter response by the victim. While the response is
unfortunate in terms of who ultimately precipitated the
incident, the victim who is now taking the action into his
hands becomes the aggressor and must be held accountable.

Using a Threat Assessment Team or a trained group of
individuals would be the proper approach in this scenario
and in future incidents. The conduct of the Threat
Assessment Process would involve the total analysis of
information and intelligence available about the
participants, the incident and the environment in order to
render a fair and impartial outcome. Being properly trained
is key. Knowledge of how to conduct a fact finding
investigation is critical to the successful determination of
the type of disciplinary action or criminal prosecution it
might bring. The process should be synchronized and well
coordinated and reflective of the organization’s leadership
team, if possible to insure that the preliminary
responsibility of conducting the fact finding investigative
process does not fall on the shoulder’s of the Security
Director long after the fact. The major players of the Threat Assessment Team might include at a minimum: the Immediate Supervisor, Personnel & Human Resource Managers, Employee Assistance, Safety and Security Managers to insure a thorough Threat Assessment (Investigation) is conducted.

In Assessing the above scenario the root cause of the
confrontation was the unabated name calling, verbal abuse
and innuendos, created by a permissive and improperly supervised environment. Supervisors who fail to step in to correct this type of behavior can be held civilly liable and responsible for their failure to act early or appropriately to prevent escalation or confrontations. In cases of death or serious injury between employees or customers, wrongful death law suits are often filed in addition to criminal prosecution. Not knowing is no longer a legitimate excuse.

When supervisors fail to act appropriately, management has the burden of investigating the incident, dealing with the issue of the aggressor over the contributory behavior of the instigator and decide on the appropriate progressive disciplinary actions (or if necessary, referral to local police for prosecution).

And, so while a Zero Tolerance Policy is necessary and
highly recommended, it should not be an absolute standard in
administering discipline until the “root cause” of the
contributory behavior becomes clear through the Assessment
Process. When controlling or addressing the potential fruits
of unwelcome behavior or to more appropriately, prevent
incidents dealing with a Workplace Security Issue, every
situation should not be resolved in the same manner with the
same administrative decision. Any broad-brush approach to
enforcing the Zero Tolerance Policy sours the innocent
bystanders and prejudices the potential witnesses who may
fear retaliation or retribution, factors which may further
complicate the disciplinary process and/or criminal
referral.

Sounds familiar? It does to me. And I know that being a good consultant the only thing you basically need to do is to listen.

How can you be a good listener?

Your ego is your life-time-partner. A shadow that is hanging over you and you cannot punish. You have to live with him (or her).
What you could do is start writing. Either publicly, like here at ezinearticles or private, keeping a dairy or something else.

All that you have written, you do not have to tell anymore. You have said it once and that should be enough. If people like it they can rate your article, if they do not bother, they won’t. So your knowledge was not that important.

I know for myself that I can appear arrogant to others. But what I want others to do is to listen to what I’m telling. And the more I talk, the less important does it seem all together. And that is when I can start listening.

If you have experienced this, you also know that you should listen to others. Everybody has an interesting story to tell, but they give up in the moment. There are so many of us that shout and want attention.

I think that what ever market is inefficient. And so is the market of communications. Those who talk all the time, should listen more and those who are afraid to communicate their ideas are undervalued for the wrong reasons. Stand up for yourself.

I will continue to write. But only to make time to listen.

Do you ever worry about always having to rely on getting seeds and fertilizer from the store? What would you do in a survival situation, if you could not go to a store to purchase these things?

Let’s compare it to your food supply. What would you do about your store-purchased food? Many wise people buy more than they need of food items that store well, and create a “year’s supply” of the essentials in their basement or other cool, dry place. This is the biblical answer. As you may remember, Joseph in Egypt saved grain for 7 years and then fed the whole Egyptian nation, as well as his own family and others, during the next 7 years of famine.

The same approach will work even better for gardening - with both seeds and fertilizers. For about $25 you can buy the triple-sealed Garden In A Can from Mountain Valley Seeds, with enough non-hybrid seeds to grow a 1/2-acre garden! If these are stored in a cool dry place they will remain viable for a very long time. The website is www.mvseeds.com, and I highly recommend you get a can, or the smaller Garden in a Pouch for about $12.

And if natural mineral fertilizers are kept dry, they will store indefinitely while still maintaining their potency. Therefore I suggest you also buy and store enough Pre-Plant Mix and Weekly Feed to grow at least one year’s garden. The formulas for mixing your own are in the Learn section of the Food For Everyone Foundation’s website at www.growfood.com.

A rule of thumb for how much fertilizer you would need to store, in order to have your year’s supply, is 6# of Pre-Plant and 12# of Weekly Feed per 30′ soil-bed. Even though you will only feed some crops 4 or 5 times, remember that if you are really living out of your garden, you will be growing two or three crops, and doing it from March or April, right up until frost in October. Therefore, see the following chart for suggestions on how much to store, depending on the size of your garden.

Now, what can you do if the emergency goes beyond a year, and you’ve used up all your fertilizer? First off, don’t expect the same quantity of production as you obtained with balanced mineral nutrients, but you can grow a healthy garden using manure tea. Here’s how.

Get a large burlap bag and a 55-gallon barrel. Find cow or horse manure (chicken or turkey is twice as hot, so less will be needed), and fill the bag 2/3’s full. Place the bag in the barrel and fill it with water. Let the manure soak or “steep” for 24 hours, then use the “tea” to water your vegetable plants. Replace the bag of manure in the barrel and let steep for 48 hours. Again, water with the tea, then dump the spent manure out and till into an unused portion of the garden. It has very little nutrient value, but can improve your soil tilth. Remember to plant a little further apart when doing this, because plants will be competing for less available nutrition. And every watering should be with the manure tea for your plants to thrive. You should expect to grow a smaller garden, and spend some time finding manure and hand-watering.

If manure just isn’t available, save your kitchen scraps and human waste. Many countries do it all the time, so it’s not the end of the world. And all clean, healthy plant residue should be saved and properly composted for re-use in the garden - again preferably as manure tea.

By the way, even 4 soil-beds, when properly worked and cared for, especially if combined with good seedling production, could produce a large amount of food. As an example, if only one crop was grown, you could produce 2,000# or more of tomatoes, or even cabbage - if you grew 3 crops. So is this approach cost effective? You do the math. Suppose you invest $50 in your year’s supply of seeds and fertilizers. What will 2,000 pounds of vegetables be worth to your family during hard times? Think of Joseph in Egypt!

1. Because they are unbreakable, unchangeable laws of life that work for everyone, everywhere, all the time!

They are just and beneficial for everyone at all times and in all places. These natural laws can create chaos and suffering when you misapply them and create beauty and harmony in your life when you use them in the highest way.

2. Because you will aspire to have the kinds of relationships you truly want.

Using the universal law of like begets like, you must first decide to be how you want others to be with you. For example, if you would like to have patience shown to you, you must show patience to others. If you want positive, supportive, honest relationships, you must be positive, supportive and honest first. Remember, others will not mistreat you if you never mistreat someone else!

3. Because you reap what you sow!

Through your words and actions, you sow seeds which grow, and you will reap the results in your life. With this in mind, every negative word or action is a weed seed. In some way it is based in fear or distrust or other destructive attitude and will produce negative and disappointing results in your life. Plant only positive seeds and you will get positive results!

4. Because you want to eliminate difficulty and problems in your life.

Guard against an expectancy of difficulty or problems. Do not look for them or they will find you! Expect and prepare only for the best. Whatever happens to you is always good, because it is always for a greater understanding, a lesson to learn, or another step in your growth to a higher consciousness.

5. Because you want to give your best to others.

If you wish to help others, universal law requires that your first priority be to care for yourself. If you neglect yourself in order to take care of others, you can only care for others to the point of self depletion.

6. Because you want to be the co-creator of your life.

By the choices you make throughout your day, you create your life. If you wish to change your life, you must change your choices! Prepare for change by raising your consciousness in accordance with your inner guidance and trust that you will be supported by the universe.

7. Because the truth will free you!

The only viewpoint from which you can see the truth and learn it’s lesson is to reach a consciousness that’s higher than the one from which you created the problem. Unless you seek truth from your Spiritual Source, answers will be based on the limits of your mind and experiences and those answers may not be what you need.

8. Because you want to create a sense of balance in your life.

Balance is handling all aspects of life in a way that results in the greatest good for you and others. Balance is a continuous process. The well rounded aspect of balance is achieved through moderation in all things, excess in none, and keeping your activities in accordance with your core values.

9. Because what you believe is what you see!

Every happening in your life comes as a result of some belief you hold. Each happening is, therefore, an opportunity to examine and change that belief, if you want to. That which you can conceive, plus that which you can believe, is that which you can achieve.

10. Because your full potential isn’t realized until it is given away.

To the degree you truly and unselfishly give, you bring the transforming power of love to any situation, condition or relationship. Your full potential isn’t realized until you let it flow outward, generating creativity, healing, peace, beauty, and joy, transforming your life and the lives of those you touch.

Names are embroidered in digitized lettering style in addition to names; logos are also digitized before being embroidered.

Teaching Your Boy the Game

For those who “coach your son” (or those players who are coached
by Dear Old Dad), lend me your ears. Here are some quick and
easy thoughts to answer the common problems that surround
coaching your own kid.

1st & Foremost Help him become the best player that He wants to
be. When it becomes more about You, the coach, the player’s Dad
. . . rethink immediately because you just became ONE OF THEM!
You know the guy who’s son plays shortstop and pitches, he bats
3rd . . . always . . . and probably shouldn’t . . . yes, there
are worse things to be than a pushy baseball Dad . . . so the
good news is . . . it’s curable! But seriously . . . think about
this . . .

2nd Consider the reality of the above and understand that you
probably would treat discipline and talk to your own boy
differently than you will with the other 12 kids on your team.
So when you need to discipline ANY of your team attempt to do
this “evenly” and with the same methods. This may take practice
as well as having a pre-season discussion with your boy, as he
knows Dad and just may attempt to take advantage (I know . . .
not my boy!). REVISIT #1 . . . lol. Along with this thought is
the idea of playing time and position play. On all teams there
are weak links and positions you just cannot find a player to
fill. It’s a common problem especially at the younger level up
to around age 13.

Here’s my own experience. I have coached my son through many
levels, from Tee Ball on up. One year we didn’t have a catcher,
so he played catcher a lot when not pitching. At the next level,
a player I counted on for a lot of pitching left a hole at short
and yet another season, a hole at 2nd. My first reaction each
year was the same . . . teach my son the essentials of these
positions . . . as long as he understood that he would be
helping the team, and me as well. Confiding in him how I was
proud of him to make the sacrifice didn’t hurt either.

3rd Is it easy? Not every day. Know this now! Why should it
always have to be easy? Very few things that are important to
two people are always easy. Know that you are each other’s
favorite coach and favorite player. Nothing is more important
than that!

Here’s the Downside: Your boy won’t progress quite as quickly in
what you may see as his “natural position.”

Here’s the Upside: Until approximately age 14 he doesn’t have a
natural position. He has ability and interest in his “natural
position” and he has Dad hoping he will play and excel at his
“natural position.” But unless any boy gets experience all over
the field, he may not truly find that “natural position.”

My son had as much fun as a catcher throughout his 11-12-13
years as any time I ever saw him play another position . . . for
whatever his reasons were. His experience there was due to his
team’s needs. It ended up allowing him to learn and do something
he never really thought much about or had much interest in. It
also helped me out of a jam because he got good at it. And yes,
he enjoyed it! It also helped our pitchers because he improved
where they could count on him . . . and now, as an older player,
it allowed him to understand the game infinitely better, now
that he is developing into a pitcher and a solid middle
infielder.

Ultimately, all it took was he and I initially discussing it (I
asked for and frankly needed his help - I truly believe that
kids like to help), and secondly I spent time working with him
at home, one-on-one, and at the park, which gave us time for
just he and I! That time is worth it just by itself. . . the
added benefit is that it was time spent at a baseball field!

Under the category of “never say never,” my son’s High School
asked him to play shortstop on the JV summer team a few years
ago. He regarded it as quite an honor, as he was only an 8th
grader in a school of 2,000 students. Although he certainly had,
and has, a lot of learning to do at such a complex position…I
think he was extremely happy that he was at least forced out of
his “natural position” earlier in his career and could call on
past game experiences. It certainly made for a more confident
and enjoyable transition!
